Fees and Schedule

Article 7 of the INDIE engagement policy contains provisions related to minimum fees. All Artists are free to negotiate above the minimum fees. There is no requirement to provide Equity with proof of payment to the Artist under the INDIE.

Article 12 of the INDIE contains provisions related to scheduling for all rehearsals, costume fittings (including travel time), photo/media calls, recordings, meetings, performances, or any other activities or services required of the Artist.

Fee Options

The Theatre and Artists must agree to ONE of the following fee options for ALL Artists on the production:

Option A — No Deferment

A standard minimum weekly fee that does not vary.

Option B — Deferred Fee

A combination of a minimum weekly fee (less than Option A) and a weekly deferment amount, based on a share of the revenue.

Revenue is defined as box office proceeds, any presentation fee, or other amounts generated during the run of the production (ie. bar sales, merchandise, donations, etc.). If there is no reasonable expectation of revenue, the deferment option is not allowed.

Term of Engagement

Unless otherwise stated, all Artists, including the Director and Choreographer (engaged on a weekly fee basis), must be engaged from the first day of rehearsal until the final performance.

Stage Managers

Stage Managers are entitled to additional compensation for their daily prep time. This additional fee provides for up to 6 additional hours (no more than 1 hour per day) to be used for stage management daily prep work only.
Stage Managers are required to have a minimum of 3 days of prep before the production starts, unless there is a valid reason to waive the prep days.

Choreographer, Fight Director, and Intimacy Director

Choreographers, Fight Directors, and Intimacy Directors can be contracted on an hourly basis if the work required does not need a full-time engagement. The minimum call per day is 3 hours.

Schedule Options

The Theatre and Artists must agree to ONE of the following scheduling options for ALL Artists on the production:

Traditional

A standard work week consisting of up to 42 hours, including all rest breaks.

Additional considerations include:

The first call of the morning cannot be before 7:30 a.m. and the workday must end not later than midnight
A workday consists of not more than seven (7) out of eight (8) hours per day
On all days, there must be a meal break of at least 1 hour after not more than 4 hours of work, unless the Artist is called for one continuous call of five 5 hours
Pro-rated days at the beginning or end of an Artist’s engagement are paid at not less than ⅕ of the weekly contractual fee, for each day worked
The Theatre is responsible for paying the Artist an amount equal to the weekly insurance premium for each week that isn’t paid in full

Flexible

The standard 42 hour work week may be pro-rated over any agreed to length of time. An Artist, however, cannot be paid less than the weekly minimum fee for each 42 hour block (or part thereof) that they work.

Additional considerations include:

Work hours in a week cannot exceed 42 hours, including all rest breaks
The first call of the morning cannot be before 7:30 a.m. and the workday must end not later than midnight
A workday consists of not more than seven (7) out of eight (8) hours per day
A meal break should be given if the work schedule spans a normal mealtime and must be given for every 4 hours of work
The Theatre is responsible for paying the Artist an amount equal to the weekly insurance premium for each week that isn’t paid in full

The agreed upon flexible schedule must be provided to Equity and must form part of the Artist’s engagement contract. Although the hours of work have been agreed upon by the Theatre and the Artist, if Equity perceives an unsafe or unhealthy work schedule, Equity, upon discussion with the Theatre and the Artist, reserves the right to re-negotiate the schedule.
